Alpine Elegant Chocolate Fountain Rental Contract

We look forward to creating part of the fun and excitement at your upcoming special event with the Alpine Elegant Chocolate Fountain! The following terms and conditions pertain to your rental of the Alpine Elegant Chocolate Fountain:

Your Alpine Elegant Chocolate Fountain rental fee is set forth as agreed upon in your application request. In order to secure the availability of the Alpine Elegant Chocolate Fountain for your event, we require a deposit of $250 which was charged at the time of your online reservation. This also included your acknowledgement and agreement to this rental contract. The deposit will be applied against your total Alpine Elegant Chocolate Fountain rental fee. Accepted payment forms are Visa, MasterCard, American Express, and Discover Card. A credit card must be on file with Alpine Chocolate Fountains.

This agreement may only be cancelled writing. You may cancel the Alpine Chocolate Fountain within 48 hours after reservation for a full refund, and up to 4 calendar weeks before the scheduled rental date for a $100 refund of your deposit. If you cancel the Alpine Chocolate Fountain rental within 4 calendar weeks of the event, you may us it toward another event within 120 days or forfeit the entire deposit.

The balance of the Alpine Chocolate Fountain rental fee and any other additional costs agreed upon will be charged to the credit card provided 10 days prior to the date of your scheduled event. You will be charged for any state, county or city license fees or sale or other taxes that may be imposed as a result of the rental and/or use of the Alpine Chocolate Fountain or our services at the event. If we do not receive payment as described above, then this contract shall be null and void and we shall be entitled to retain the entire deposit as liquidated damages.

You agree to provide:
  1. Sturdy and level table capable of supporting 150 pounds. Once the Chocolate Fountain has been set up at the specified location, it cannot be moved during the event.
  2. Sufficient power for the operation of the Chocolate Fountain, which requires at least one 120-volt circuit that supplies at least 15 amps according to normal safety standards, within 20 feet of the setup area.
  3. Access to setup room and table at least 90 minutes prior to the start of the event.
  4. Access to a kitchen and sink facilities.
  5. You accept full responsibility and liability for any damages, injuries, delays, or inability to use the Alpine Chocolate Fountain if the above requirements are not met or for actions outside of our control.
  6. Repairs or replacement costs will be billed to the credit card on file.
  7. Alpine Chocolate Fountains has the right to take and use photos/videos showing the use of the Alpine Chocolate Fountain for the limited purpose of advertising and promoting the service to our prospective customers.

Our chocolate concierge is our sole responsibility and will have sole responsibility for setting up, operating, cleaning and removing the Alpine Chocolate Fountain.

This Agreement represents the only warranties, express or implied, between the parties. Alpine Chocolate Fountains shall not be liable for any injury, loss or damage directly or consequently arising out of the use or inability to use the Alpine Chocolate Fountain, whether used singularly or in conjunction with any other equipment. Client will hold harmless Alpine Chocolate Fountains in the event of illness, injury, power outage, act of God, force of nature, or any other situation beyond control of Alpine Chocolate Fountains that prevents Alpine Chocolate Fountains from performing. In the event of litigation all parties agree to mediation first. Any litigation will be restricted to the county of San Diego, in the state of California. Client will indemnify Alpine Chocolate Fountains against, and hold Alpine Chocolate Fountains harmless from all claims, actions, proceedings, costs, damages and liabilities, including attorney fees, arising out of, connected with, or resulting from the use of the Alpine Chocolate Fountain. In any event we otherwise fail to provide the products or services as contracted for, your sole remedy will be the refund of all monies you paid us. Any change required or permitted under this agreement shall be given in writing by fax, e-mail, or by U.S. Mail. Any such notice shall be acknowledged to have been submitted on the date it is received by Alpine Chocolate Fountains.

We will retain your credit card number on file in the event of repairs or replacement deemed necessary as a result of your use of the fountain rental. This will also be used to allow our chocolate concierge to add additional chocolate or remain for additional time over the contracted time of the event, and avoid an uncomfortable situation in which the concierge must collect funds during the event in order to fulfill any last minute requests. Your card will not be charged for additional services without your request for such additional services at the time of the event.
